Buyback Terms & Conditions

These Buyback Terms & Conditions (“Buyback Terms”) apply when KiwiQuest offers you an optional buyback option for a vehicle sold through KiwiQuest Camper Sales (Camervans). They are separate from our general Terms of Service and from the Deposit cancellation policy. If a buyback option is shown on your listing, sales confirmation, or Buyback Offer, these Buyback Terms govern that option.

1. Definitions

  • KiwiQuest means KiwiQuest OÜ and the KiwiQuest Camper Sales / Camervans sales channel.
  • You / Purchaser means the person named as buyer on the sales contract or Buyback Offer.
  • Vehicle means the specific vehicle identified in your sales confirmation or Buyback Offer.
  • Buyback Option means KiwiQuest’s option (if granted) for you to sell the Vehicle back to KiwiQuest under these Buyback Terms.
  • Buyback Offer means the written offer or schedule that states the buyback percentage and any special conditions for your Vehicle.
  • Buyback Period means the time window in which you may exercise the Buyback Option (see section 3).
  • Guaranteed Buyback Price means the percentage of the original purchase price (including GST, unless your Buyback Offer says otherwise) stated in your Buyback Offer or sales confirmation, less any deductions allowed under these Buyback Terms.

2. Nature of the Buyback Option

  • The Buyback Option is optional and applies only if your Buyback Offer or sales confirmation expressly grants it for that Vehicle.
  • Subject to these Buyback Terms, if you validly exercise the Buyback Option during the Buyback Period, KiwiQuest will buy the Vehicle back at the Guaranteed Buyback Price.
  • The Guaranteed Buyback Price is the percentage of the original purchase price stated in your Buyback Offer or sales confirmation, less any deductions under sections 5 to 7. It is not a market valuation or a promise of the Vehicle’s retail value at return.
  • These Buyback Terms do not replace your rights under New Zealand consumer law, including the Consumer Guarantees Act 1993. Those rights are not excluded.

3. Buyback Period (time limit)

  • The Buyback Option stands for up to one (1) year.
  • Unless your Buyback Offer or sales contract states a different start date, the Buyback Period starts on the purchase / handover date of the Vehicle and ends at 23:59 New Zealand time on the day before the first anniversary of that date (or on the end date expressly stated on your Buyback Offer or sales contract, if earlier).
  • You may only exercise the Buyback Option during the Buyback Period. After the Buyback Period ends, the option expires automatically and KiwiQuest has no obligation to buy the Vehicle back under these Buyback Terms.

4. How to exercise the Buyback Option

To exercise the Buyback Option, email team@kiwiquest.de (or the contact stated on your Buyback Offer) with:

  • Your full name and the email used for the purchase
  • Vehicle identification (listing link, registration plate, and/or VIN)
  • A clear statement that you wish to exercise the Buyback Option
  • Your preferred return date within the Buyback Period
  • You must give KiwiQuest at least five (5) working days’ written notice before the proposed return date, and bring the Vehicle to the return location KiwiQuest confirms in writing (return location as advised by KiwiQuest for your listing / region until a fixed address is published).
  • Before completion, you must present the Vehicle for a pre-return inspection at the time and place KiwiQuest arranges. KiwiQuest may also require you to attend settlement with proof of identity and ownership.
  • KiwiQuest may require proof of identity and ownership of the Vehicle at any time in connection with the Buyback Option.

5. Condition of the Vehicle

  • The Vehicle must be returned in good condition, allowing only ordinary and fair wear and tear for the age, mileage, and intended use of a campervan of its type.
  • You must return the Vehicle with clear title, free from security interests, unpaid purchase money, unpaid finance, and free from outstanding traffic, toll, parking, camping, or other penalties, infringement fees, and fines. You remain responsible for any such amounts that arise from your period of ownership, even if notified after return.
  • The Vehicle must pass a VTNZ safety / condition inspection, or an equivalent inspection by a provider KiwiQuest has approved in writing for your return. The inspection report must be current (not older than two (2) days at the time of the pre-return inspection or settlement, whichever KiwiQuest specifies).
  • If the Vehicle does not pass the VTNZ (or approved equivalent) inspection, or is not in an acceptable condition under these Buyback Terms, the reasonable cost of repairs needed to pass that inspection or to restore the Vehicle to acceptable condition is deducted from the Guaranteed Buyback Price.
  • KiwiQuest may, acting reasonably: reject the exercise of the Buyback Option if the Vehicle’s condition is materially worse than when it was supplied (excluding ordinary and fair wear and tear), or if title / fines / inspection requirements are not met; or complete the buyback and deduct a reasonable sum from the amount payable, including repair and reinstatement costs and other deductions in section 6.
  • Condition and the amount of any deduction may be determined by reference to the VTNZ / approved inspection report and KiwiQuest’s reasonable assessment of the Vehicle at pre-return inspection.

6. Deductions

Without limiting the repair-cost deduction above, KiwiQuest may deduct from the Guaranteed Buyback Price (among other things):

  • Damage beyond ordinary and fair wear and tear (including accident damage, unrepaired body or interior damage, cigarette odours, spills, and staining)
  • Missing original accessories or equipment supplied with the Vehicle (including but not limited to curtains, mattresses, bedding bases, toilet or cassette, kitchen fittings, water tanks, solar or power accessories listed on the sale, spare keys, and owner’s documents)
  • Missing, expired, or non-current Warrant of Fitness (WOF), vehicle licence (rego), or required service records where these affect roadworthiness, legality of use, or remarketability
  • Costs to replace expendable or maintenance items that are unsafe or leave the Vehicle below an acceptable return standard (for example worn tyres below legal tread, failed battery where it prevents safe operation)
  • Any unpaid fines, penalties, or charges attached to the Vehicle or your ownership period
  • Reasonable costs to clear title or remove encumbrances you were obliged to clear

Ordinary and fair wear and tear does not include the items above, nor damage caused or contributed to by neglect, improper use, unapproved major modifications, taking the Vehicle out of New Zealand (unless your Buyback Offer expressly allows it), or use that would void ordinary insurance cover.

7. Care and validity of the option

For the Buyback Option to remain valid, you must (as far as reasonably practicable):

  • Keep the Vehicle registered and with a current WOF while you own it
  • Service and maintain the Vehicle in a manner consistent with manufacturer guidance and campervan use
  • Keep reasonable records of services and material repairs
  • Not take the Vehicle out of New Zealand unless your Buyback Offer expressly allows export / overseas travel
  • Take reasonable steps to protect the Vehicle from further damage after any incident

Any evidence of fraud, odometer tampering, or an attempt to mislead KiwiQuest about the Vehicle’s identity, ownership, mileage, or condition immediately voids the Buyback Option.

8. Payment

  • After a valid exercise, clear title transfer, return of keys and accessories, and agreement (or reasonable determination) of any deductions, KiwiQuest will pay the net Guaranteed Buyback Price to the bank account you nominate in writing.
  • Payment timing will be confirmed in writing for your return (typically within a stated number of working days after settlement; exact cadence to be confirmed by operations). KiwiQuest may pay in one amount or, if stated on your Buyback Offer, in staged amounts.
  • All amounts are in New Zealand dollars unless your Buyback Offer states otherwise, and are treated as including GST where GST applies to the original purchase price calculation used for the percentage.

9. Non-transferable

The Buyback Option is personal to you. You may not sell, transfer, or assign the Buyback Option or any rights under these Buyback Terms without KiwiQuest’s prior written consent. A change of registered owner without that consent ends the option.

10. Governing law and consumer rights

  • These Buyback Terms are governed by the laws of New Zealand. The parties submit to the non-exclusive jurisdiction of the New Zealand courts.
  • Nothing in these Buyback Terms excludes, restricts, or modifies rights you have under the Consumer Guarantees Act 1993 or other non-excludable New Zealand consumer law. The Buyback Option is an additional contractual option, not a substitute for those rights.

11. Relationship to other policies

  • Deposit payments and cancellations before a completed sale are covered by the Deposit cancellation policy, not these Buyback Terms.
  • General website / service use is covered by the Terms of Service.
  • If there is a conflict between a signed Buyback Offer / sales contract special condition and these Buyback Terms, the signed special condition prevails for that Vehicle to the extent of the conflict.
